1. Controller

ITV Studios is a trade name of ITV Studios Holding B.V. (a division of ITV (Europe) Holdings B.V.) and its affiliates (“ITV Studios” or “we”). These Conditions of Use apply to all websites, apps and accounts (jointly referred to as “Digital Services” or individually as a “Digital Service”) of ITV Studios, unless other conditions are expressly declared applicable. ITV Studios, is a private limited liability company, having its registered office at Familie De Mollaan 1, 1217 ZB Hilversum.

2. Applicability

By using a Digital Service of ITV Studios you accept these conditions.

If a Digital Service uses or refers to third-party services, general conditions, conditions of use, privacy policies and cookie policies of the third parties in question may also apply. ITV Studios is not responsible for third-party services and refers in that regard to the conditions and statements of those third parties on their own websites or apps. Please note that those conditions and statements may change on a regular basis. Such changes are beyond ITV Studios’ control.

If you provide us with personal data, such as your name or email address, via a Digital Service our Privacy Policy and our Cookie Policy apply. We advise you to read the Privacy Policy and the Cookie Policy carefully before providing us with those data. If it is possible to take part in promotional or other campaigns via a Digital Service, additional conditions may also apply. Our Privacy Policy and Cookie Policy prevail in all cases.

ITV Studios may amend these Conditions of Use at any time. Your use of a Digital Service is governed by the conditions that apply at the time of use. We request you to check these conditions on a regular basis.

3. Use of a Digital Service

You can find information on ITV Studios’ products and services, among other things, via ITV Studios’ Digital Services. You can also register via some Digital Services, for instance to take part in or to attend a radio or television programme, or to use the Digital Services as a “second screen” during a television broadcast.

Always carefully protect your account data and passwords when registering via one of the Digital Services. Never disclose those data to anyone. As a user, you yourself are responsible for all the activities that take place in your account. Make sure that your data are correct and up-to-date at all times. If you suspect that another party has gained access to those data, let us know immediately at privacy.nl@itv.com so we can block your account. ITV Studios reserves the right to remove or deactivate your account at any time if it has reason to do so.

If you are below the age of 16, you need the permission of a parent or guardian to open an account. ITV Studios may verify that consent. If you use a Digital Service, you must ensure that your use of that service does not harm ITV Studios’ rights or reputation in any manner.

4. Contributions from users

If you submit information, data, pictures, video and sound fragments, or other content via a Digital Service (a “Contribution”), they may in no event be illegal or offensive (including sexist, pornographic, racist or discriminatory) and may not otherwise infringe a third party’s privacy. You furthermore warrant that you will not introduce or spread computer viruses via the Digital Services or take any other action that may harm any functionality of the Digital Services or may breach the security of the Digital Services. You also warrant that the Contribution does not infringe any intellectual property rights or other rights of third parties. If a third party is recognisably depicted or described in a Contribution, you warrant that you have obtained that third party’s consent. You indemnify ITV Studios against any third-party claim based on the provision or publication of a Contribution.

ITV Studios cannot check all Contributions beforehand. We are therefore not responsible or liable for the content of the Contributions offered via the Digital Service. We reserve the right to shorten, alter or remove a Contribution at any time.

5. Intellectual property rights

All intellectual and other property rights, including copyrights, trademark rights and database rights regarding the content and design of the Digital Services, including the underlying software, are vested exclusively in ITV Studios and/or its licensors. The right to use a Digital Service does not imply the transfer, licensing or granting of a right of use or other right in respect of the aforesaid intellectual property rights by ITV Studios to the user. No part of the Digital Services may be copied or uploaded elsewhere and ITV Studios’ trademarks may not be used without ITV Studios’ prior consent.

By submitting, publishing or uploading your Contribution, you grant ITV Studios an irrevocable, free of charge, worldwide, perpetual, sub-licensable and transferable licence to use the Contribution in all current and future media. Insofar as permitted by law, you then waive in relation to ITV Studios any and all personality rights that you may have. The licence granted in respect of your Contribution allows ITV Studios to use the Contribution worldwide and to commercialise it without any limitation, via any media and in any form, including radio and television programmes, social media and websites.

6. Disclaimer

The Digital Services have been compiled with the greatest care. However, ITV Studios cannot warrant that the Digital Services will always be available or will always function without any interruption, error or defect, and that the information provided is complete, correct or up to date.

ITV Studios reserves the right without prior notice to temporarily or permanently terminate the Digital Services, without that giving rise to any rights for you or any liability for damages on the part of ITV Studios. ITV Studios is not required to replace the Digital Service or to provide another Digital Service if the Digital Service is temporarily or permanently terminated without prior notice. ITV Studios is also not required to make backup copies of data saved by you on our Digital Services.

ITV Studios is not liable for any information, Contributions and other materials or statements (including advertisements) published or made available by you or third parties via the Digital Services. ITV Studios reserves the right (without prior notice) to remove certain information, Contributions or other materials or statements published via a Digital Service.

ITV Studios is also not liable for any damage or personal injuries caused by the use of the Digital Services, other websites, social media and other media to which it refers, for instance via hyperlinks.

The limitations of liability set out above lapse if the liability is due to intent or gross recklessness on the part of ITV Studios.

Without prejudice to the other provisions of these Conditions of Use, you are liable for and indemnify ITV Studios against any third-party claims based on the use of the Digital Services, breach of or non-compliance with statutory obligations, or use of the Digital Services in breach of these Conditions of Use.

7. Transfer

ITV Studios may transfer all or part of the Digital Services to an affiliate of ITV Studios. ITV Studios may also transfer all or part of the Digital Services to a company that is not affiliated with ITV Studios. ITV Studios reserves the right in all cases to keep and use a copy of its own of the Digital Services. If ITV Studios transfers all or part of the Digital Services to a company not affiliated with ITV Studios, it gives notice of such transfer via the Digital Services.

8. Governing law and dispute resolution

These Conditions of Use are governed by Dutch law.

These Conditions of Use do not affect your statutory rights as a consumer.

Disputes regarding these Conditions of Use are submitted to the court that has jurisdiction under Dutch law.

9. Amendments

These Conditions of Use were most recently amended on 1 January 2020.
